Affiliate Agreement

This agreement governs your participation in the Giddy Pets affiliate program. Version 2026-07-22 — last updated 22 July 2026. By applying to or participating in the program, you agree to it.

1. Who this is between

This agreement is between Giddy Pets, a trading name of Matthew Garnett, a sole trader based in the United Kingdom (“Giddy Pets”, “we”, “us”, “our”), and you, the person or business applying to be an affiliate (“you”, “affiliate”). Together, the “parties”.

2. Eligibility

  • You must be at least 18 years old and legally able to enter into this agreement.
  • You must own or be authorised to promote through the channels, websites, handles or audiences you register with us.
  • You must comply with all laws and regulations that apply to you and to your promotion of us, including advertising, consumer-protection, data-protection and tax law.

3. Joining & approval

  • Participation is by application. We may accept or decline any application at our sole discretion, and we don't have to give a reason.
  • Approval is personal to you and your registered channels. You may not transfer, sell or share your affiliate account, code or link.
  • On approval we'll issue you a unique referral code and link. Keep your account details accurate and up to date.

4. Commission

  • We pay commission of 10% (or the rate shown in your dashboard) of the product subtotal of a qualifying order — that is, the price of goods excluding delivery charges, taxes, gift wrapping, and any discounts or credits applied.
  • Commission is earned only on orders that are placed, paid in full, and not cancelled, returned, refunded or charged back.
  • Commission is not earned on your own purchases, purchases you arrange, or orders we reasonably believe are fraudulent, fake, or made to manipulate the program.
  • We may change the commission rate or the list of eligible products on a forward-looking basis by updating this agreement or your dashboard; changes don't affect commission already earned.

5. How sales are tracked (attribution)

  • When someone clicks your referral link, we place a cookie in their browser that lasts 30 days. If they buy within that window, the order is attributed to you.
  • Attribution is last-click: if a customer later clicks another affiliate's link before buying, that later affiliate is credited. Attribution also fails if the customer clears cookies, uses a different device or browser, or blocks tracking. We are not liable for lost attribution outside our reasonable control.
  • Our records of clicks, orders and commissions are final and determinative, absent manifest error.
  • You must not attempt to manipulate tracking — including cookie stuffing, forced clicks, iframes, redirects, adware/malware, typosquatting, or any deceptive technical method.

6. Payment & the return hold

  • Each commission is held for 30 days from the sale date to allow for returns and refunds. After the hold, if the order still qualifies, the commission “clears” and becomes payable.
  • If an order is returned, cancelled, refunded or charged back at any time — including after the hold — the related commission is reversed. We may offset reversed or overpaid amounts against your future or current balance, or invoice you for amounts already paid on orders later refunded.
  • We pay cleared commissions manually to the payout method you provide (e.g. PayPal or bank transfer). You are responsible for giving us correct payout details; we're not liable for payments sent to details you provided incorrectly.
  • We may set a minimum payout threshold and a regular payout schedule, shown in your dashboard. Small balances may roll over until the threshold is met.
  • All amounts are in pounds sterling (GBP). You are solely responsible for any taxes on your commission, including income tax and, if applicable, VAT. You confirm you are acting as a principal for your own account, not as our employee or agent.
  • We may withhold or delay payment while we investigate suspected fraud, a breach of this agreement, or a chargeback dispute.

7. How you may promote us

You must promote us honestly and lawfully. You must:

  • Clearly disclose that your links are affiliate/paid links, in line with the UK CAP Code and ASA guidance (and equivalent rules where your audience is) — e.g. “#ad” or “affiliate link”.
  • Only make truthful claims about our products, and never make veterinary, medical or health claims we haven't published.
  • Keep your content appropriate and lawful.

You must not:

  • Send spam or unsolicited messages, or post your link where it isn't permitted.
  • Bid on our brand terms (e.g. “Giddy Pets”) or misspellings in paid search, or use our name in your domain, ad account or paid placements without our written permission.
  • Use coupon, voucher, cashback or deal sites, or offer unauthorised discounts, rebates or incentives to drive clicks, unless we approve it in writing.
  • Misrepresent yourself as us, imply we endorse you beyond this program, or use our trademarks, logos or content except as we allow.
  • Promote us via content that is misleading, defamatory, obscene, discriminatory, infringing, or otherwise unlawful.

8. Use of our brand

We grant you a limited, non-exclusive, revocable, non-transferable licence to use our name, logo and approved marketing materials solely to promote us under this program, following any brand guidance we give. All goodwill from that use belongs to us. This licence ends automatically when your participation ends, and you must then stop using our brand and remove our materials.

9. Your relationship with us

You are an independent contractor. Nothing here creates an employment, agency, partnership or joint-venture relationship. You have no authority to make offers, give warranties, incur liabilities or otherwise act on our behalf. You are responsible for your own conduct, content, staff, costs and taxes.

10. Suspension & termination

  • Either party may end this agreement at any time, for any reason, on notice (email is fine).
  • We may suspend your account and withhold payment immediately if we reasonably suspect fraud, manipulation, or a breach of this agreement. If we terminate for your breach or fraud, you forfeit any unpaid commission and must repay commission paid on affected orders.
  • On termination for any reason, no further commission accrues; validly earned, unaffected commission that has cleared will be paid in the normal course. Sections that by nature should survive (including 4–6, 9, 11–14) survive termination.

11. No guarantee

We don't guarantee any level of earnings, traffic, availability, or that the program will continue. We may change, pause or close the program, and change eligible products, rates, cookie length or these terms, at any time on a forward-looking basis.

12. Data protection

We process your personal data (e.g. your contact and payout details, and your referral activity) to run the program, under our Privacy Policy and UK GDPR. You must handle any personal data of your own audience lawfully and must not pass us personal data about others except as needed to run the program.

13. Liability & indemnity

  • The program is provided “as is”. To the extent the law allows, we exclude all implied warranties and are not liable for indirect or consequential loss, loss of profit, or loss of anticipated commission.
  • Except for liability that can't be excluded by law, our total liability to you under this agreement is limited to the total commission paid to you in the 12 months before the claim.
  • You will indemnify us against any claims, losses, and reasonable costs arising from your breach of this agreement, your promotion of us, or your content.

14. General

  • This agreement, together with our Terms & Conditions and Privacy Policy, is the entire agreement between us about the program.
  • We may update this agreement; the version in force is the latest published. Continuing to participate after a change means you accept it. Each application records the version you accepted.
  • If any part is found unenforceable, the rest stays in force. Our not enforcing a term isn't a waiver of it. You may not assign this agreement; we may.
  • This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
